Anascape originally Sued Nintendo back in 2005 at the same time they sued Sony and MS for the same thing...Copyright infringement, MS took out thier pocketbook and settled out of court with a $49 million check to Anascape (Pocket change to MS), Sony and Nintendo both went to court with the "Go ahead Sue me attitude I got more money then your company"..Sony lost the lawsuit and was ordered to pay them $40 million (this is why the PS3 didn't have rumble at first, because SONY was going through the lawsuit) and Sony's ended with them losing thier appeal and having to pay the money...then the courts FINALLY went to Nintendo's case four years later...and ordered them to pay Anascape as well...

Anascape didn't wait untill the Wii was huge to sue, it just the case took it's time to go through the courts, as anyone who has been in a court case knows they can take a long time (ask R. Kelly about his 6 year court case)...

although I hate when companies file a patent and copyright and then don't do anything with it...I think that's bad business but in this case...Nintendo was definately in the wrong...
