Another point even if they did not have the money to go through the lawsuit couldn't they have let the info leak (or just give) to big news sites like IGN, Gamespt, 1UP, or Kotaku? I find it hard to imagine that they would let news like that pass right by them and imagine how much attention Nintendo, Sony, and Microsoft would pay attention to them then.

Ok let me give you a scenario...let's say Anascape did wait till Nintendo "made it big" to get more money, what's wrong with that...
If you were going to rob a store...would you rather rob a gas station and get a couple hundred dollars maybe a thousand and be set for a day or two...or would you rather rob a bank and get 40 - 50 thousand and be set for a couple months or a year....exactly Anascape robbed the bank instead of the gas station...more power to them....
