A single atom does not contain the amount of energy needed to kill a person.

The reason an atom bomb works is because it uses a large number of atoms, all of which have a massive number of Electrons and Protons. After the first atom splits, it starts a massive pinball chain reaction because the electons it launches collide with other atoms, causing them to split as well. When this is done with enough atoms of the right size, the effect is devestating. Since, however, you did not specify the number or kind of atoms, we are to assume it is a single atom of a simple element like Hydrogen. There would be no massive explosion. There wouldn't even be a spark.

I'm still debating whether or not that should be the situation in this case. If a single atom causes a giant chain reaction resulting a huge explosion, many would argue that it's not the single atom that killed by itself. Then I would say "It set off a chain reaction, so therefore it is the culprit." This would result in a lot more arguing then needed >_>, so I really don't know what to do with the atom as of now.

I still stick by my ideal of having ONE single atom disqualified, as it is not tangible by its lonesome self.

Technically an atom is tangible, and you said you can use other items to help in the killing, which would allow you to use the matter around the atom you split for the chain reaction.
